Key principles in the measurement of BEE compliance

Compliance is to be measured at the time of measurement – initiatives not yet implemented are not taken into account.
Substance takes precedence over legal form
Misrepresentation of BEE Status may lead to disqualification of scorecard
Initiatives to split enterprise in 2 or more – EME, QSE & Start-up Enterprises may lead to disqualification of scorecard – example: to form a separate “fronting” company that is BEE Compliant
Any representation bearing upon BEE Status must be supported by suitable documentation or evidence
Where a Standard Valuation Method is used, it must be consistently applied.
