CRITICAL B-BBEE UPDATES IN THE TRANSPORT SECTOR: KEY CONSIDERATIONS 2024

Since 2009, the transport sector has operated under specific operational guidelines which are undergoing significant revision to align with the Department of Trade and Industry's (DTI) latest Codes of Good Practice. The draft sector code for the Transport Sector was released in 2016, and the updated codes are set for publication in 2024 without any transitional period.


Key Changes Ahead

The forthcoming revisions will introduce several adjustments affecting how transport companies are evaluated under B-BBEE criteria:


  • Ownership Control: Emerging Micro Enterprises (EMEs) and Qualifying Small Enterprises (QSEs) will need to calculate their ownership control using the flow-through model. Entities can also earn increased points for Black New Entrants, subject to refined definitions and qualifications.


  • Management Control and Employment Equity: These two elements will merge into a single category with a specific emphasis on inclusion of Black females. Entities failing to submit their Employment Equity (EE) Reports will forfeit points under Management Control.


  • Skills Development: Entities will be restricted to absorbing learners into permanent positions, with a mandate to achieve absorption targets set at 5% of total employees as outlined in their EE plans. Moreover, businesses are encouraged to allocate a portion of their resources to support higher education initiatives.


  • Enterprise and Supplier Development: Supplier development, Enterprise development, and Procurement will be consolidated into a unified element. New provisions mandate that entities collaborating with QSEs or EMEs ensure these suppliers are 51% Black-owned and 30% Black Female-owned.
